Appeals Process

If an employee disagrees with the initial decision regarding an accommodation request or believes an accommodation was not provided in a timely manner, the employee has a right to seek reconsideration through one or more of the following methods:

  • For employees represented please refer to your collective bargaining agreement, the collective bargaining agreement outlines complaint procedures, process, and timelines
  • For employees not eligible to file a complaint or grievance under a collective bargaining agreement or whose collective bargaining agreement incorporates CSU system-wide complaint procedure, please refer to the complaint procedure outlined in . Refer to Title IX Office procedures on how to file a Discrimination, Harassment or Retaliation Complaint to the Office of Equity & Inclusion.

Nothing in these procedures should be construed to impede or prohibit a timely filing of an ADA or discrimination complaint with the appropriate external government agency.

Retaliation

Retaliation against an employee for filing a disability accommodation request, or for filing a complaint or an appeal with the Title IX Office is prohibited. CSUDH strives for inclusive excellence and prohibits discrimination due to your disability. If you believe you are experiencing discrimination due to your disability that has not been resolved by the ADA accommodations process, please submit a complaint to the Office of Equity and Inclusion online report form or the Office of Equity & Inclusion.
